Three Laws Every San Diego Rental Owner Must Understand

California rental law is layered. State law sets the floor. The City of San Diego adds local protections on top. And recent legislation has changed the rules on security deposits, habitability, and more. This is a plain-language summary of what applies to your property right now. It is not legal advice. Consult an attorney for guidance specific to your situation.

Rent Increase Cap

Annual rent increases are limited to 5% plus local CPI, with a hard ceiling of 10%. San Diego CPI for 2024 was approximately 3.6%, making the current effective cap around 8.6%. Owners must provide 30 days written notice for increases of 10% or less, 90 days for increases above 10%.

Just Cause Eviction

After 12 months of tenancy, owners cannot terminate a lease without a legally recognized reason. At-fault reasons include nonpayment, lease violations, nuisance, and criminal activity. No-fault reasons include owner move-in, withdrawal from the rental market, and substantial renovation.

Who Is Exempt

Properties exempt from AB 1482 include single-family homes and condos owned by individuals (not corporations or REITs), properties built within the last 15 years, and owner-occupied duplexes. The exemption must be communicated to the tenant in writing. Failure to provide the notice means the property is treated as covered.

Required Notice

Every covered property must include an AB 1482 rights notice in the lease or as a separate signed addendum. As of January 2026 (AB 1529), the notice can be included directly in the body of the lease.

How the TPO Differs from State Law

The San Diego TPO is more protective than AB 1482 in several critical ways. The most important difference: just cause eviction applies from day one of the tenancy. State law does not kick in until month 12. If your property is in the City of San Diego and is not exempt, you need just cause to terminate any tenancy that has lasted more than 30 days.

Relocation Assistance

For no-fault evictions (owner move-in, withdrawal from market, demolition, substantial remodel), the landlord must pay relocation assistance equal to 2 months of actual rent. For tenants who are seniors (62+) or disabled, the amount increases to 3 months. Payment is due within 15 calendar days of the termination notice. This is in addition to returning the security deposit.

Right of Return

If a property is offered for rent within 5 years of a no-fault eviction, the displaced tenant must be offered first right to lease. The tenant has 30 days to accept. The landlord may screen the returning tenant using standard criteria.

Owner Move-In Restriction

For leases signed after June 24, 2023, owner move-in is only permitted as a termination reason if the lease expressly includes that right. If it was not in the original lease, the landlord cannot add it unilaterally. This catches many owners off guard.

SDHC Eviction Notice Registry

Landlords must file eviction notices with the San Diego Housing Commission within 3 business days of serving the tenant. This applies to both at-fault and no-fault terminations.

Exemptions

Several exemptions mirror AB 1482, with one critical addition: properties issued a certificate of occupancy within the last 15 years are exempt. However, if the property is owned by a corporation, LLC with a corporate member, or REIT, the single-family/separately alienable exemption does not apply. Ownership structure matters.

Required Notices

Landlords must provide tenants with a written Notice of Residential Protections plus a hard copy of the Tenant Protection Guide. An electronic link does not satisfy this requirement. For tenancies that began after June 24, 2023, these must be included in the lease or signed at execution.

Deposit Cap

As of July 1, 2025, security deposits for unfurnished residential units are capped at 1 month’s rent. No exceptions for higher-risk tenants. No additional pet deposits allowed beyond this limit.

21-Day Return Requirement

The full deposit or an itemized statement of deductions must be provided to the tenant within 21 calendar days of move-out. Failure to comply can result in the tenant recovering up to twice the deposit amount in damages (bad faith penalty under CC 1950.5).

Electronic Return (AB 414, effective 2026)

Landlords must offer tenants the option to receive their deposit refund via electronic transfer. For multi-tenant units, a written agreement is required specifying how the refund will be split and delivered. Specific notice requirements apply depending on whether rent was paid electronically.

Itemization Rules

Deductions must be itemized with receipts or good-faith estimates. California applies useful life depreciation: carpet (8–10 years), paint (2–3 years). Normal wear and tear is not deductible. When in doubt, the law favors the tenant.

AB 628 — Stove and Refrigerator Are Now Habitability Items

Every residential rental unit must have a working stove and refrigerator. If either fails, the landlord must repair or replace within a reasonable time. Recalled appliances must be replaced within 30 days. Tenants can use the repair-and-deduct remedy or vacate without penalty if the landlord delays. Applies to leases entered, amended, or extended on or after January 1, 2026.

SB 610 — Disaster Obligations

After a natural or manmade disaster, landlords must remove debris, mitigate hazards (mold, smoke, ash, asbestos, water damage), and follow government cleanup protocols. The tenant has the right to return at the same rent once the unit is habitable. Rent is not owed during mandatory evacuations.

AB 246 — Social Security Eviction Defense

If a tenant’s Social Security benefits are delayed through no fault of their own, the court must stay eviction proceedings for up to 6 months. The tenant must pay all past-due rent within 14 days of benefits resuming. This is not a loophole. It is a legal defense that a court will enforce.

AB 1414 — Internet Service Opt-Out

Tenants must be given the option to opt out of any bundled internet subscription offered with the tenancy. If the landlord charges for it without offering opt-out, the tenant can deduct the cost from rent.

AB 325 — Pricing Algorithm Risk

Using common pricing algorithms to set or align rents can now violate California’s Cartwright Act if done as part of a coordinated pricing arrangement. Fines up to $6M for corporations. This does not prohibit using market data tools independently. It targets coordinated use of shared algorithms to stabilize or inflate prices.

Week 1: Paperwork and Access

You complete the Getting Started Form covering property details, utility accounts, HOA contacts, vendor preferences, keys, and appliance inventory. We set up your owner portal so you can see statements, documents, and maintenance updates in real time. You get login credentials and a walkthrough of how it works.

Week 2: Property Assessment

We conduct an initial property condition inspection with photos, video, and a written report. This becomes the baseline for every future comparison, including move-out disputes. We identify deferred maintenance and recommend immediate repairs versus planned improvements. We assign preferred vendors by trade.

Week 2–3: Tenant Transition (If Occupied)

If there is an existing tenant, we issue a formal notice of change in management. This notice includes our contact information, maintenance submission instructions, the emergency line number, and all disclosures required by Civil Code 1962. We collect the current lease, verify terms, confirm rent and deposit amounts, and redirect rent payments to our trust account. We confirm renters insurance compliance.

Week 2–4: Listing and Marketing (If Vacant)

We run a comparable market analysis to set the rent. Professional photography and listing preparation. Your property goes live on all major rental platforms including Zillow, Zumper, and others. All inquiries route through our leasing team.

Week 3–6: Screening and Placement (If Vacant)

Applications processed first-come, first-qualified per AB 2493. Full screening: credit, criminal background (with individualized assessment per fair housing requirements), eviction history, income verification (2.5x rent), and rental history. We make all screening decisions, protecting you from fair housing liability.

Month 2–3: Steady State

First rent collected and deposited to trust. Your first owner statement posts to the portal. Maintenance requests flow through the system and you see every work order in real time. By day 90, the property is running.

Every property we manage has the option to be covered by a layered protection structure. Each layer addresses a different type of risk. Each pays out independently. Here is what each layer covers, who provides it, and what it looks like when something goes wrong.

Layer 1

Coverage: malicious tenant damage up to $35,000 (with $1,500 deductible), loss of rent up to 12 weeks for delinquency, skip, or eviction order, eviction legal costs up to $5,000 (filing fees, attorney, sheriff/marshal), and $1M general liability.

Claims require: lease agreement, tenant ledger, move-in and move-out inspection reports, and police reports for damage claims.

Layer 2

Lease Break Protection

Best Nest waives the leasing fee.
Cost: included.

If a tenant we placed breaks their lease within 12 months of move-in, we waive the leasing fee for the replacement tenant. You do not pay twice to fill the same unit.

Layer 3

Pet Damage Coverage

Cost: $15/month per pet, charged to the tenant at lease signing for approved pets.

Covers up to $1,500 in pet-related property damage. This is separate from the security deposit, which under AB 12 is capped at one month’s rent and cannot include pet-specific additions.

Layer 4

Renters Insurance

Every tenant is required to carry a minimum $100,000 liability policy. We verify coverage at lease signing and monitor for lapses. If the tenant lets the policy lapse, Layer 5 provides backup coverage.

Layer 5

Resident Benefits Package (Optional for Tenants)

Tenants may opt out in writing at lease signing.

Includes a resident liability waiver covering up to $100,000 per incident for tenant-caused property damage. This coverage activates on day one of the lease regardless of whether the tenant maintains their own renters insurance. Also includes credit building (rent reported to all three bureaus), identity theft protection ($1M coverage), and quarterly air filter delivery.

The property needs new flooring, drywall repair, full cleaning, and appliance replacement. Here is what activates:

SureVestor (Layer 1) covers up to $35,000 in malicious damage. After the $1,500 deductible, $16,500 is covered. The claim requires documented move-in and move-out inspections plus a police report if the damage is intentional. The security deposit (up to 1 month’s rent under AB 12) applies toward remaining costs. Beagle’s liability waiver (Layer 5) provides an additional $100,000 per incident if needed.

Owner’s likely out-of-pocket: the $1,500 deductible and any costs exceeding the combined coverage. Without these layers, the owner absorbs the full $18,000.

The tenant is two months behind. The eviction process in San Diego takes 60 to 90+ days from first notice to lockout. Here is what activates:

SureVestor (Layer 1) covers lost rent for up to 12 weeks during the eviction process. It also covers up to $5,000 in legal costs: attorney fees, court filing, and sheriff coordination. Renters insurance (Layer 4) and the liability waiver (Layer 5) remain active during the process.

Owner’s likely out-of-pocket: the deductible and any rent loss beyond the 12-week coverage window. Without these layers, the owner is covering lost rent, legal fees, and turnover costs that routinely reach $10,000 to $18,000 in California.

The pet damage waiver (Layer 3) covers up to $1,500 in property damage. The security deposit applies toward any remaining balance. If the damage exceeds both, the liability waiver (Layer 5) provides additional coverage up to $100,000 per incident.

Owner’s likely out-of-pocket: minimal, unless the damage significantly exceeds $1,500 and the deposit combined.

What to Handle and When

Maintenance has a rhythm. Compliance has deadlines. This calendar is a general guide covering both. It is built for San Diego’s climate and California’s regulatory calendar. Every property is different. A 1960s hillside home has different maintenance demands than a 2015 condo. Use this as a framework and adjust for your property type, age, and condition.

January

Year-end financial summary prepared. 1099s issued to owners by January 31 (IRS deadline). Review insurance policies for upcoming renewals. Confirm renters insurance compliance for all tenants.

February

Exterior inspection: check for any winter rain damage to roofing, gutters, and drainage. Confirm smoke detectors and carbon monoxide detectors are functional (California law requires both). Review any leases expiring in the next 90 days and begin renewal conversations.

March

HVAC filter replacement. Schedule spring landscaping and irrigation checks (water conservation compliance). Begin preparing vacant units for peak leasing season (April through August).

April

Peak leasing season begins. Professional photography and listing updates for any vacancies. Review rent comp data for renewal pricing. File annual tax returns (personal deadline April 15, corporate S-Corp deadline March 15).

May

Schedule HVAC maintenance before summer heat. San Diego’s cooling season starts earlier than most owners expect. Inspect weather stripping and window seals. Review and update vendor contacts.

June

Mid-year property inspection (drive-by exterior). Confirm all units have working stove and refrigerator per AB 628. Check for any deferred maintenance that should be addressed before summer tenants settle in.

July

Security deposit rules reminder: AB 12 cap of 1 month’s rent applies to all new leases. Review pet damage waiver enrollment for any new tenants. Quarterly air filter delivery (Beagle RBP).

August

Peak leasing season winds down. Evaluate vacancy rate and adjust pricing strategy for fall. Begin planning any capital improvements for the slower season.

September

$99 per month flat fee plus 4.9% of gross rent collected. No management fee during vacancy. The flat base covers the fixed cost of managing any property. The percentage scales with complexity. As your rent increases, the effective rate decreases as a share of income.

Owner disbursements are processed from the trust account after rent is collected. Funds are transferred via ACH to your bank account. Your monthly statement posts to your owner portal showing every transaction: rent collected, expenses paid, management fee, and net disbursement.

No. You pay exactly what the vendor charges. We do not add a percentage or service fee to maintenance work. For projects exceeding $2,500, a 5% project oversight fee applies.

It depends on property type, age, and ownership structure. Single-family homes and condos owned by individuals (not corporations or REITs) may be exempt, but only if the tenant has been given written notice of the exemption. Protection

No. Every property is enrolled by default because we believe every property should have this level of coverage. Owners may opt out in writing. The cost is $50 per month. The coverage it provides (up to $35,000 in damage, 25 weeks of lost rent, $5,000 in eviction costs, and $1M in liability) is not available to individual landlords outside of a property management relationship.

We begin the legal process per California law. A 3-day notice to pay or quit is served. If the tenant does not cure, we proceed to unlawful detainer through our legal partners. ProtectionPlus covers up to 12 weeks of lost rent during the process and up to $5,000 in legal costs. The typical San Diego eviction takes 60 to 90 days from first notice to lockout.
